There is a war going on but it is not one we are reading about in the news.

As tax revenues decline, the federal government can operate with deficits. By law, states and counties must balance their budgets. Given that federal law and regulations create significant program requirements and expenses for state and local government, growing deficits will exacerbate the tension between the federal government and states and between states and counties.

Throughout state and local government, you have millions of people who work hard and make the day-to-day operations of government go, often with surprisingly little resources. Watching more than $10 trillion of bailouts go to a handful of large banks is deeply disturbing to them. Capping bankers compensation at $500,000 is cold comfort to a city manager or state legislator struggling to raise a family on much less.

Before passage of the stimulus package, California was not reimbursing counties for mandated programs. California counties were threatening to withhold payments to the state or sue. Right before house passage, a group of eighteen governors issued a press release supporting the Administration’s proposal. If you look at the list, it is the ones that should be hurting the most.

My read of the stimulus package is that it was designed to provide a great deal of money to ease the financial pain that the states and municipalities are experiencing. It is not described that way — but I think that is what it is and what got it passed. The stimulus package is expected to cost $789 billion. The financial stability plan is expected to add $2.2 trillion to the $8.5 trillion authorized by the US Treasury and the Federal Reserve for bank bailouts. Behind the scenes, the states had to get their half a trillion or so to go along with the bankers getting another $2.2 trillion.

After playing with the numbers, my intuition says that this money is enough to push the state problems out to September, maybe October. The states will need a lot more money in the 2010 federal budget which will go into effect on October 1, 2009. That means the House and Senate appropriations committees will be a hot place to be this summer and the September reconciliation could get pretty wild.

We now have legislators in four states that have introduced legislation to require state administration to set up electronic payment systems using gold.

Now we have rumbling about state constitutional rights in New Hampshire, Missouri, Arizona and Oklahoma:

Within the decision making circles of state and local government may be where the war for the hearts and minds of this country will be decided. A network member told me tonight they heard a state legislator announce they had persuaded state administration officials to move state funds to local banks.

Remember, state legislatures can pass laws to try to stop federal lawlessness. State and local government (including pension funds) can also stop financing lawlessness. Which would be a good thing because then we could reinvest our essential government reserves and pension funds in things that have a better chance of having and holding real value.

Brandon Creighton, the State Representative from.... Conroe, has filed a 10th Amendment Bill in the Texas House claiming state sovereignty over non-enumerated Constitutional powers. The libs are in an uproar, and Creighton is literally being stopped in the hallways of the Capitol by other legislators who want to sign on as co-sponsors.

The Minnesota Sovereignty resolution was introduced in the MN House today, thanks to chief author, Marty Seifert, and a few good men, including Leon Moe, who were behind the effort. Minnesota follows several other states this year in re-asserting their rights under the Tenth Amendment.

Sovereignty reemerged as a concept in the late 1500s, a time when civil wars had created a craving for stronger central authority, when monarchs had begun to gather power into their own hands at the expense of the nobility, and the modern nation state was emerging. Jean Bodin, partly in reaction to the chaos of the French wars of religion; and Thomas Hobbes, partly in reaction to the English Civil War, both presented theories of sovereignty calling for strong central authority in the form of absolute monarchy. In his 1576 treatise Six livres de la république ("Six Books of the Republic") Bodin argued that it is inherent in the nature of the state that sovereignty must be:
Absolute: On this point he said that the sovereign must not be hedged in with obligations and conditions, must be able to legislate without his (or its) subjects' consent, must not be bound by the laws of his predecessors, and could not, because it is illogical, be bound by his own laws.
Perpetual: Not temporarily delegated as to a strong leader in an emergency or to a state employee such as a magistrate. He held that sovereignty must be perpetual because anyone with the power to enforce a time limit on the governing power must be above the governing power: impossible if the governing power is absolute.
Bodin rejected the notion of transference of sovereignty from people to sovereign ; natural law and divine law confer upon the sovereign the right to rule. And the sovereign is not above divine law or natural law. He is above (ie. not bound by) only positive law, that is, laws made by humans. The fact that the sovereign must obey divine and natural law imposes ethical constraints on him. Bodin also held that the lois royales, the fundamental laws of the French monarchy which regulated matters such as succession, are natural laws and are binding on the French sovereign. How divine and natural law could in practice be enforced on the sovereign is a problematic feature of Bodin's philosophy: any person capable of enforcing them on him would be above him.
Despite his commitment to absolutism, Bodin held some moderate opinions an how government should in practice be carried out. He held that although the sovereign is not obliged to, it is advisable for him, as a practical expedient, to convene a senate from whom he can obtain advice, to delegate some power to magistrates for the practical administration of the law, and to use the Estates as a means of communicating with the people.
With his doctrine that sovereignty is conferred by divine law, Bodin predefined the scope of the divine right of kings.

We must stand shoulder to shoulder with states like Tennessee, Kentucky, Kansas, Indiana, and West Virginia in demanding that the federal government immediately “cease and desist” its usurpation of our liberties.

Last week, HUMAN EVENTS reported that eleven states, Washington, New Hampshire, Arizona, Montana, Michigan, Missouri, Oklahoma, Minnesota, Georgia, South Carolina, and Texas, had all “all introduced bills and resolutions” declaring their sovereignty over Obama’s actions in light of the 10th Amendment.

These actions are in response to the Obama administration’s faux-“stimulus” legislation which directly assaults the rights of states to reject the money coming from the federal government. So far, several Republican governors -- among them South Carolina’s Mark Sanford and Louisiana’s Bobby Jindal -- have said they would refuse all or part of the stimulus money because of the constitutional infringements and because of the additional unfunded liabilities they impose on the states.

This week, HUMAN EVENTS is happy to report that five more states have decided to invoke the 10th as well.

These five -- Tennessee, Kentucky, Kansas, Indiana, and West Virginia -- have all begun their action under the 10th Amendment in a bid to protect themselves from what they view as nothing less than an unconstitutional usurpation of power on the part of the Obama administration.

On February 23, HJR 108 was put forth in the Tennessee legislature, indicating that legislators in that state decided “it [was] time to affirm state sovereignty under the Tenth Amendment to the Constitution of the United States and demand the federal government halt its practice of assuming powers and of imposing mandates upon the states for purposes not enumerated by the Constitution,” according to Truman Bean.

The very next day, February 24, Kentucky State Representative John Will Stacy (D), “introduced House Concurrent Resolution 168… serving notice to the federal government to cease mandates beyond its authority.”

In declaring their sovereignty these states have joined what has come to be known as “the 10th Amendment movement.” It is a grassroots, conservative movement that seeks to defend the separation of powers as originally set forth by our Founders in the Constitution.

You know what really bugs me about the sovereignity movements?

The type of people that participate in them. I've had a chance to read a few comments on blogs referencing this news item and they are all full of people who are sour and totally anti-liberal.

How are people going to work together if they reference liberals as "the enemy" and continue the very division that the media wants people to have? As someone wisely stated here (I believe it was 777), both wings are both attached to the same bird.

I'm willing to work for Vermont Sovereignity but I will not do it until the libertarians and conservatives drop their negative attitudes about liberals. Our founding fathers were classical liberals (today's liberals aren't even close to this) and it's rather insane to see people continuing these divisions when they should DROP THEM.

I just thought of something (surely not an original thought): If potheads and gun lovers can just work together for once, we can enjoy our pot and keep our guns in peace.

My only concern with giving states more rights is the possibility of certain states allowing laws that restrict or completely take away the rights of certain groups of people.

Their success has eclipsed all the feeble attempts to impede it or to construct alternatives. And they have accomplished all this in the last few years in open defiance of the law and all principles of accepted governance. They have changed the political environment to such an extent that what we call the United States is a ghost. To those who now exercise the reigns of power, we the people are sources of money or labor or cannon fodder.

They have stolen our prosperity. They have taken the franchise from millions of our citizens and abrogated the rights guaranteed by our Constitution. In the name of security they have sacrificed our soldiers for their own gain. They discourage fruitful enterprise and commerce on any terms but their own. They do not befriend other nations. They bully and insult them. They do not strive for peace. They create enemies, real and imaginary. They are not stewards of our land and heritage. They are exploiters. They are not public-spirited or even patriotic, as they have stronger allegiances abroad than they do at home.

They do not protect. They attack. They are not committed to the well-being of the people because they must enrich the few who stride the globe like a colossus.

What next? (Secede from what?)

What next? Our preparations need not focus in secession, but rather on local agriculture and sources of energy, diplomacy, sustainability, productive labor, a healthy environment, carbon sequestering and soil building, local/complementary currencies, transportation and infrastructure after Peak Oil, and a host of other efforts that communities should do together. These are the sources of sovereignty. Sovereignty is their offspring. And such sovereignty as is not supported by them will not stand, but will be consumed by the greed and terror of those we seek to leave behind.

We must be prepared if we are to go it alone.

The federal government has proved that it has no interest or ability to help us or to keep us safe. If we think that it has or ever will again, we might as well believe in the tooth fairy.

We are already on our own.

Ah yes. How silly.

Pace Hicks, after our most recent Republican president took unprecedented liberties with the executive branch, and after the current Democratic president has promised something close to central planning, some state lawmakers have decided to take their stand. And their critics bray, “How dare any silly second or third-tier bureaucrats champion the Constitution!”

The South Carolina sovereignty resolution is but one of 15 similar state resolutions, mostly the product of Republican legislators fearful of, or looking for creative ways to circumvent, Obama’s agenda.

We, the Republican Executive Committee of Alachua County, in the great Florida State, commend our fellow several States, who have introduced Resolutions based squarely upon the Ninth and Tenth Amendments of the United States Constitution, which are particular to the thoughts, words, and actions of our Founding Father's Bill of Rights; left as Providence to their Posterity. Whether or not the States have directly claimed in Resolution or Action, their reserved Sovereign Rights, the matter remains that these unenumerated rights were not meant to deny, or disparage, those retained by the States respectively, or to the People. Discussion of the Tenth Amendment in regard to Sovereign Rights must be necessarily and properly introduced with what precedes it, in the form of the Ninth Amendment of the United States Constitution,

‘The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.'

Honored States such as Arizona, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Michigan, Minnesota, Mississippi, Missouri, Montana, New Hampshire, New Mexico, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, and Washington have introduced or passed Resolutions to assert their reserved respective rights guaranteed them by the Bill of Rights contained within the United States Constitution.

The United States of America was founded on the principle of sovereign people within sovereign states and a limited federal government. It is with a firm reliance upon these principles of ‘We, the People', that this resolution is brought forth.

We, the People, are struck with the magnitude of this endeavor. The events of history, the news of the day, the extreme, grave, and serious nature of these times compel us to now demand, for our Posterity's sake, a strong measure of action be taken to reaffirm the sovereignty of the state of Florida on behalf of all Floridians. These times require earnest, honorable, and valiant action on behalf of our Esteemed Legislature.

Using the resolution brought forth by the great State of Texas as a template from which to begin, the undersigned Republican Executive Committee of Alachua County, in the great Florida State, offer the following:

Four states have passed sovereignty bills in recent months, and another 22 have similar legislation under consideration, reports the Christian Science Moniter. One bill, in New Hampshire, went so far as to call “for outright dissolution of the Union if Washington doesn’t rein itself in,” but was one of the two which have been voted down to date.



“If you set up the principle where the federal government can do everything, then, yes, eventually they will do everything. If not, where’s the line they can’t cross?” says Michael Boldin, president of the Tenth Amendment Center in Los Angeles. “That’s the Constitution, I believe.”

The courts mainly stood by as federal power expanded by great leaps in the 1930s and the 1960s. There’s been another burst of federal expansion in the 2000s, including Mr. Bush’s USA Patriot Act and Obama’s proposed overhaul of banking regulations.

The fact is, “there’s no longer any effective limitations on federal power,” says Randy Barnett, a Georgetown law professor who argued for California’s medical marijuana law in front of the Supreme Court.

“This is a wake-up call,” said a state legislator from South Carolina, where a sovergiegnty bill was successfully passed, “And if Washington doesn’t heed that wake-up call, revolution is on the horizon.”

USA centric post.

You know, it's a strange dichotomy we've gotten ourselves into. Big business is out of control, has been for years (translate TPTB). Now, businesses may fail in this particular mess, but they're going to take us down with them.

Most states leges are pretty much circuses, and certainly can't control TPTB, but when anyone starts to talk about either protectionism or regulation at the federal level, everyone gets all upset and starts wanting to clamp down on the federal government.

We're darned if we do and darned if we don't. And the PTB still manage to make money.

This should be an interesting game to watch out. Started your garden yet?

House Democrats objected, saying the issue already had been taken up and had been vetoed, but House Speaker Pro Tempore Kris Steele, R-Shawnee, ruled the veto is not final action.

Key said he expects HCR 1028 will pass in the Senate. HJR 1003 earlier passed the House 83-18 and won approval in the Senate 29-18.

Henry vetoed HJR 1003 because he said it suggested, among other things, that Oklahoma should return federal tax dollars.

Key said HCR 1028, which, if passed, would be sent to Democratic President Barack Obama and the Democratic-controlled Congress, would not jeopardize federal funds but would tell Congress to "get back into their proper constitutional role." The resolution states the federal government should "cease and desist" mandates that are beyond the scope of its powers.

Key said many federal laws violate the 10th Amendment, which says powers not delegated to the U.S. government "are reserved to the states respectively, or to the people." The Constitution lists about 20 duties required of the U.S. government, he said.

Congress should not be providing bailouts to financial institutions and automakers, he said.

"We give all this money to all these different entities, including automakers, and now they're talking about, ‘Well maybe it's better to let them go bankrupt,'" Key said. "Well, maybe we should have let them go bankrupt before we gave them the money."
