Remind me why these people aren't being tried in Federal Court in New York?

From the link in the first post:

Scenes of chaos have gripped a US military court in Guantanamo Bay where five alleged 9/11 plotters were due to appear together before a judge. All five, including alleged mastermind Khalid Sheikh Mohammed, initially refused to attend the hearing. The judge rejected prosecution calls for them to be compelled to attend but three did appear after a recess. The hearing focuses on whether two of the accused are mentally competent to represent themselves. The 11 September 2001 attacks, in which hijacked airliners were flown into buildings in New York and Washington, killed nearly 3,000 people. Walid Bin Attash, Ali Abd al-Aziz Ali and Mustafa Ahmad al-Hawsawi appeared in the courtroom after the recess.

Relatives of 9/11 victims were watching the hearing. But Mr Hawsawi asked to leave again after he was refused the opportunity to speak. He was escorted out by US military guards. Mr Bin Attash asked the judge whether he could question a witness. When told he could not, he asked: "Even if he told lies?" When the judge again insisted he could not question the witness, Mr Bin Attash replied: "This is good justice!" Thursday's hearing was meant to focus on whether Mr Hawsawi and a fourth defendant, Ramzi Binalshibh, were mentally competent to represent themselves.

The US military lawyer representing Mr Binalshibh said he suffered from a delusional disorder. When the lawyer went into detail about how he had been deprived of sleep, her microphone was cut off. The fifth defendant, Mr Sheikh Mohammed, refused to attend the hearing. Described by US intelligence as "one of history's most infamous terrorists", he earlier admitted being responsible "from A to Z" for 9/11. Believed to be the number three al-Qaeda leader before his capture in Pakistan in March 2003, he told a pre-trial hearing at Guantanamo in December 2008 that he wanted to plead guilty to all charges against him.

The Obama administration has yet to announce how the five defendants will be tried or where they will be held if the camp at Guantanamo Bay is closed by January 2010, as promised. US President Barack Obama has ordered a halt to military commissions at Guantanamo Bay but preparations continue for military trials and prosecutors say they are ready to begin proceedings against 66 detainees. Mr Obama has conceded that some will be tried in military courts once Congress passes legislation which puts in place a number of legal safeguards.

Why? Because this is all b.s. and they know that the 911 Truthers would come out en mass to protest the entire dog and pony show....that's why.

I don't mean to sound belligerent about it I am just so tired of 'them' already.

Love to all

I hadn't heard anthrax thrown in with Cheney's name yet. As for these 'hearings,' I can't remember the name of the military prosecutor who quit in disgust last year. I'd like to see it all turned (the tables).

Cheney linked to anthrax attacks, torture, domestic spying, and giving Dick a bad name.

In another piece of evidence that justice is alive and well in the state of Vermont even as it was put on hold for eight years under the Cheney-Bush regime, Senator Patrick Leahy’s calling for a Truth Commission to investigate whether or not crimes were committed by the likes of Cheney.

Leahy has been such a thorn in Cheney’s side, trying to investigate the Haliburton war profiteering, trying to stop the Patriot Act from being rammed through Congress, that Cheney once famously told him to **** off. But was Cheney also trying to scare Leahy into silence with Anthrax? There was a Daily Kos article last month putting together some of the evidence that Leahy may have been singled out for the Anthrax attacks that hit the nation during all this, attacks that eerily targeted Democrats who opposed what the Bushies were doing in the name of security.

Military commissions system 'broken': former Guantanamo prosecutor
Andrew Morgan at 11:21 AM ET
http://jurist.law.pitt.edu/paperchas...tem-broken.php

[JURIST] A former prosecutor at Guantanamo Bay [JURIST news archive] told the House Judiciary Committee [official website] Wednesday that the military commission [JURIST news archive] system used to try detained enemy combatants is "broken beyond repair." In testimony [prepared remarks, PDF] at a hearing [materials] before the Subcommittee on the Constitution, Civil Rights, and Civil Liberties, Lt. Col. Darrel Vandeveld, US Army Reserve Judge Advocate General Corps [official website], said that although he was a "true believer" when he was detailed to the detention facility, he had come to believe that the commissions undermined "the fundamental values ... upon which this great country was founded." Asked by the subcommittee to address the legal issues surrounding the continuance of the military commission system...

Despite this, it looks like it's all status crooked quo.

I can't believe that people are telling Pat to move on. I support the truth commission but I don't think that it'll go anywhere without the support of folks like Ron Paul and so forth.

Some people call Vermont a socialist paradise but in reality, this is also the state of the Green Mountain Boys and other freedom-loving folks.

Yeah. This whole sh**show is bigger than the stupid, little accusations of left, right, centre, off the edge, whatever.

I hope Pat Leahy stays in the game.
