Frank Said to Back Broader Fed Audits

Rep. Ron Paul said he has a commitment from the chairman of the House Financial Services Committee, Barney Frank, to advance the Texas Republican's legislation opening the Federal Reserve to broader federal audits.

In an interview Friday, Mr. Paul said Mr. Frank agreed to allow a vote on the bill and to work on language that would allow the Government Accountability Office, the investigative arm of Congress, to audit the Fed's monetary-policy operations. While details are unresolved, the discussions increase the likelihood that some version of Mr. Paul's bill will pass the House.

"Barney told me, 'It's going to come. You're going to get what you want,' " Mr. Paul said. "We're going to have some hearings and we'll get a vote."

Rep. Frank Seeks Compromise on Fed Audit Bill

WASHINGTON (Reuters, Sat Aug 29, 8:23 pm ET) – Rep. Barney Frank, the chairman of the U.S. House of Representatives Financial Services Committee, hopes to craft a compromise bill with lawmakers who want to open Federal Reserve monetary policy decisions to audits, a spokesman for Frank said on Saturday.

A bill sponsored by Texas Republican Rep. Ron Paul that would allow the Government Accountability Office, a federal watchdog agency, to audit Fed interest-rate decisions has won the co-sponsorship of more than half of the House.

Fed Chairman Ben Bernanke has warned the bill would compromise the U.S. central bank's policy-making independence and could undermine financial markets and the economy.

The Financial Times reported on Saturday that Frank hoped to bring forward compromise legislation that would safeguard the Fed's independence, while enhancing transparency and creating checks and balances for the central bank's use of emergency lending powers.
Steven Adamske, a spokesman for Frank, told Reuters the congressman would work with Paul on a compromise bill. He said compromise language had not yet been written and provided no further details. A spokesman for Paul could not be reached....(Continue)

Seventy-five percent of Americans agree with us that it's time to thoroughly and completely audit the Federal Reserve System.

Every Republican and over one hundred Democrats in the House of Representatives have signed on as cosponsors of HR 1207. Almost a quarter of the Senate has gotten on board with S 604.

So what does this tell us?

It's time to go get the rest!!

On Friday, September 25th the House Financial Services Committee has scheduled a full committee hearing on Ron Paul’s HR.1207 to audit the Federal Reserve. The hearing is slated to begin at 9am eastern time. For details and a link to the (eventual) live streaming video of the hearing check out the committee website.

As with many of these committee hearings the schedule is tentative and right now there are no witnesses listed.

HR 1207 is having a hearing tomorrow on auditing The Federal Reserve.

There has been much made of whether a Fed Audit would "compromise" Fed independence.

This is the wrong standard to apply.

The correct standard is whether The Fed should, under the law, be truly independent in the first place. There I look to The Constitution.

Article 1 says in part: http://www.law.cornell.edu/constitut....html#section2

Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;

To borrow money on the credit of the United States;

To regulate commerce with foreign nations, and among the several states, and with the Indian tribes;

To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the United States;

To coin money, regulate the value thereof, and of foreign coin, and fix the standard of weights and measures;

To provide for the punishment of counterfeiting the securities and current coin of the United States;

Notice two things:

It is Congress that has the right to borrow money, not Treasury. Those are very different branches of government (legislative .vs. executive.) Ergo "Treasury Bills" are in fact, absent explicit authorization (and no, a "debt ceiling" is not explicit authorization) unenforceable against The United States (are the Chinese aware of what our Constitution says, and that under a plain reading of it they are in fact holding worthless toilet paper should we so decide?)

and

It is Congress that has the right to regulate the value of money (through control of its issuance and value), not The Fed or Treasury (the executive.) That power rests in the legislative branch of government - and nowhere else.
These Constitutional provisions stand, 230-some years later, unchanged by lawful amendment.

Now let's talk about what The Fed has usurped on their own initiative in direct contravention of The Constitution, and therefore, as it stands at present, The Fed is operating in a form and fashion that requires The Congress (singularly and in conjunction, where each member has taken an oath to uphold and defend the Constitution from all enemies, foreign and domestic) to act. I shall list each of my charges and specifications along with the evidence thereupon against The Fed as currently constituted:

Earlier today, Congressman Paul appeared on MSNBC to discuss his efforts to Audit the Fed (hearing tomorrow!) and the need for transparency.

I am speaking this morning in support of HR 1207, the Federal Reserve Transparency Act. As the Committee knows, this bill would require a full audit of the Federal Reserve by the Government Accountability Office (GAO).

On November 10, 2008, Bloomberg News ran the following headline: “Fed Defies Transparency Aim in Refusal to Disclose.” The story pointed out that the Fed was refusing to identify the recipients of trillions of dollars in emergency loans or the dubious assets the central bank was accepting as collateral. When the initial $700 billion congressional bailout was being debated last September, Fed chairman Ben Bernanke and then-Secretary of the Treasury Hank Paulson couldn’t emphasize their commitment to transparency strongly enough. But “two months later, as the Fed [lent] far more than that in separate rescue programs that didn’t require approval by Congress, Americans [had] no idea where their money [was] going or what securities the banks [were] pledging in return.”

Not only is Fannie paper NOT full faith and credit but in addition THEY ARE EXPLICITLY DISCLAIMING AGENCY STATUS!

This is on the face of EVERY Fannie (and Freddie) prospectus. All of them. So where is the authority of The Fed to buy this paper, given the constraints in Section 14? http://www.federalreserve.gov/aboutthefed/section14.htm

Who is The Fed bailing out by monetizing Fannie and Freddie paper when it is quite clear on the face of that prospectus and a clean read of Section 14 that they don't have the authority to buy that paper in the first place?

Now do you understand why The Fed doesn't want to be audited? And why we get threats about "disruptions" if, in fact, The Fed is audited?

The Horrible Conundrum Facing The Fed

The Committee will maintain the target range for the federal funds rate at 0 to 1/4 percent and continues to anticipate that economic conditions are likely to warrant exceptionally low levels of the federal funds rate for an extended period.

has set up a completely-untenable position for The Fed and the greater economy.

The problem The Fed and America faces is that this latest "blast of the liquidity firehose" is not limited to The United States in its impact.

Indeed, the problems that this sort of "monetary policy" generates have almost nothing to do with the US Economic picture - rather, they have everything to do with the international nature of markets and monetary flows and the impact that such a policy pronouncement has on them.

Ron Paul visits New York Federal Reserve

On September 29th 2009 Ron Paul hosted a book signing for 'End the Fed' at the Borders Books in the financial district of New York. While being escorted to an engagement on Wall Street by a few members of the NYC C4L he asked, "is the the Federal Reserve building close by?" After he found out it was he led the way for a photo op in front of the Fed's most powerful branch, the New York Federal Reserve Bank.
